Intoxication Assault Penalties

According to Texas law, if a DWI arrest also causes serious bodily injury to another person, then the crime can be charged as intoxication assault. Serious bodily injury is defined as injury which causes extensive impairment or loss of function of any organ or limb, or involves a considerable risk of death. Intoxication assault is classified as a third-degree felony, which is punishable by a prison sentence between two and ten years, as well as a fine of up to $10,000.
