WHAT IS IDENTITY THEFT?
According to Texas Penal Code §32.51, someone who obtains, possesses, transfers, or uses a person’s identifying information without that person’s permission and with intent to defraud or harm another. In Texas, fraudulent use or possession of identifying information can result in either a state jail felony, felony of the third degree, felony of the second degree, or felony of the first degree.
WHAT ARE THE PENALTIES FOR IDENTITY THEFT?
The following are the penalties and sentences based on how many items were obtained, possessed, and transferred in the crime:
- Less than five items
- State jail felony
- 180 days to two years in a state prison
- Maximum fine of $10,000
- Between five and nine items
- Second degree felony
- Two to 20 years in a state prison
- Maximum fine of $10,000
- Between ten and 49 items
- Second degree felony
- Two to 20 years in state prison
- Maximum fine of $10,000
- 50 items or more
- First degree felony
- Five to 99 years in state prison
- Maximum fine of $10,000
